Defective slab pours on a subdivision build

Commercial LitigationConstructionBreach of contract
Six-figure supplier credit and remediation agreement

The situation

Core samples on four new-construction lots showed the concrete supplier had delivered pours well below the specified strength. The builder faced remediation costs and closing delays on all four homes, and the supplier’s carrier issued a reservation-of-rights letter.

What we did

  • Retained a structural engineer to document the failures and the remediation scope.
  • Filed suit for breach of contract and redhibition to protect the builder’s deadlines while negotiations continued.
  • Negotiated directly with the supplier and its carrier toward a resolution that kept the commercial relationship intact.

The result

The matter resolved with a supplier credit covering the engineer’s remediation estimate, an agreed schedule for the corrective pours, and dismissal of the suit. The builder closed all four homes.
