The situation
Our client agreed to buy a commercial lot in Slidell for cash, with the seller leasing the property back for twelve months. The title commitment listed an exception for a utility servitude that did not appear in the public records and would have restricted future construction.
What we did
- Traced the servitude through the utility’s easement records and obtained a written release of the unrecorded portion.
- Drafted the act of sale and a lease-back with rent, insurance, and maintenance obligations allocated to the seller.
- Coordinated the closing with the title company so the release, the sale, and the lease were recorded together.
The result
The purchase closed on the original date with clean title, and the lease-back provided income to the buyer during the planning period for redevelopment.
