Chapter 7 discharge of medical and credit-card debt

BankruptcyChapter 7Means test
Full discharge; home and vehicle retained

The situation

After a hospitalization and a job loss, our clients were carrying about $60,000 in medical bills and credit-card balances with no realistic path to repayment. They were worried about losing their home.

What we did

  • Completed the means test, which they passed comfortably as a household of two below the Louisiana median.
  • Applied Louisiana’s homestead and vehicle exemptions to protect their house and both cars.
  • Prepared and filed the petition and schedules, and represented them at the meeting of creditors.

The result

The court entered a discharge of all unsecured debt roughly four months after filing. The clients kept their home and vehicles and reaffirmed only the mortgage.

Client identity withheld; identifying details generalized. Past results do not guarantee or predict a similar outcome in any future case.
